# FAQ to General T&C Clients and Project Contract
4.6 Fairpicture gives no assurance that all photographs and videos contain the complete metadata . ( Was heisst das genau?)
- Wir sind sehr genau und verlangen ausführliche Metadaten von unseren Visual Creators. Das klappt auch sehr gut - trotzdem aber gibt es Fälle, in denen wir ungenaue und/oder fehlende Metadaten haben.
Aus der Projektofferte:
- 2.3.2 The client may pass on the visual material to the media and other third parties exclusively free of charge as part of its public relations work. The condition is that the author is named in accordance with the credit specifications below.
- 2.4 … In particular, the client is not entitled to pass on the visual material to third parties in return for payment or to allow third parties to use it in return for payment.
- In Bezug auf 2.3.2 und 2.4: Unsere Kunden kaufen bei uns CO2-Zertifikate. Bei grösseren Kunden wird auch eine Kommunikationspartnerschaft in Rechnung gestellt, um unsere Aufwände, v.a. auch zeitliche Ressourcen, zu decken. Darin enthalten sind auch immer Fotos. Wir stellen aber nicht die Fotos einzeln in Rechnung. Geht das so in Ordung?
- Ja, voll ok - Ihr verkauft ja die Bilder so nicht im eigentlichen Sinne (heisst: Eure Kunden haben nicht automatisch ein Nutzungsrecht auf Bilder, sondern Ihr gebt diese weiter im Sinne der Kooperation).
2.9 Alle dem Auftraggeber eingeräumten Nutzungsrechte an dem Bildmaterial erlöschen,
2.9.3 fünf Jahre nach der Herstellung des Bildmaterials.
Hm, das finde ich noch herausfordernd. Unsere Projektwebseiten sind erfahrungsgemäss länger als fünf Jahre online. Wenn wir da jedes Mal prüfen müssten, wann ein Bild abläuft und sie dann überall in 4 Sprachen herunternehmen müssen, wäre das recht aufwändig. Oder wie ist das genau gemeint?
- In der Praxis des DSGVO ist nach 5 Jahren Schluss - das ist eine Praxisregel, die sich am Einpendeln ist. Wir gehen mit unseren Rechtsberatern davon aus, dass diese «Ablaufregel» in absehbarer Zeit auch rechtlich verbindlich werden wird - Bilder können nur noch dann länger gebraucht werden, wenn für sie eine erneute Einverständniserklärung einverlangt wird. Heisst: Unabhängig von uns müsst Ihr da wohl sowieso eine Regelung finden über kurz oder lang. Bei Lanschaftsbildern und Projektbildern ohne Einverständniserklärung ist das eh kein Thema - aber bei Bildern mit Menschen (von denen alle eine Einverständniserklärung/ Consent abgegeben haben sollten) macht es auf jeden Fall Sinn, wenn das «Recht auf Vergessen» einen hohen Stellenwert hat.
